Terms of Service

Welcome to Cardly Market! These Terms of Service (“Terms”) govern your use of the Cardly Market mobile application, website, and related services (collectively, the “Service”). By downloading, accessing, or using Cardly Market, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use Cardly Market. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. Cardly Market is not intended for children under 13, and we do not knowingly collect information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA).
2. Account Registration
- You must provide accurate and complete information when creating an account, including your real name, valid email address, and date of birth.
- You are responsible for maintaining the confidentiality and security of your account credentials.
- You must notify us immediately of any unauthorized access to or use of your account.
- You may not transfer your account or use another user’s account without permission.
- One account per person. Creating multiple accounts to evade bans, manipulate the system, or for any other reason is prohibited.
- We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to the community.
3. The Cardly Market Marketplace
3.1 Role of Cardly Market
Cardly Market provides a platform for users to buy, sell, and trade collectible cards, including but not limited to Pokémon, Magic: The Gathering, Yu-Gi-Oh!, One Piece, Disney Lorcana, sports cards (baseball, basketball, football), and sealed products. Cardly Market acts solely as a marketplace facilitator. We are not a party to transactions between users and do not own, possess, inspect, or authenticate the cards listed on our platform.
3.2 Listings
- You must accurately describe items you list, including condition, authenticity, grading status, and any defects.
- If listing a graded card, you must accurately represent the grading company and grade (e.g., PSA 10, BGS 9.5).
- You must upload clear, truthful photos of the actual card(s) being listed. Stock images alone are not sufficient for sale or trade listings.
- Listing counterfeit, stolen, or illegally obtained cards is strictly prohibited and will result in immediate account termination and may be reported to law enforcement.
- Prices must be set in good faith. Price manipulation, shill bidding, and artificially inflating card values are prohibited.
- You retain ownership of cards until a transaction is completed and confirmed.
3.3 Transactions (Buying & Selling)
- When you accept an offer or complete a purchase, you enter a binding agreement with the other user.
- Sellers must ship items within 3 business days of payment confirmation using a Cardly Market shipping label or approved tracking method.
- Buyers must inspect items and report any issues within 48 hours of delivery confirmation.
- All sales are final unless the item is significantly not as described, counterfeit, or damaged in transit.
- Cardly Market holds payment in escrow until the buyer confirms receipt or 7 days after delivery confirmation, whichever comes first.
3.4 Trading
Cardly Market supports two types of trades: Shipping Trades and In-Person Trades.
Shipping Trades
- Card-for-card trades are facilitated through our trade matching system.
- Both parties must pay applicable trade fees before shipping.
- Both parties must ship within 3 business days after trade fees are paid.
- Both parties must confirm receipt within 7 days of the last shipment being delivered.
- Trade protection applies when both parties use Cardly Market shipping labels and follow all shipping guidelines.
- Cards involved in an active trade are locked and cannot be listed for sale or included in other trades until the trade is completed or cancelled.
In-Person Trades
- No trade fees are charged for in-person trades. We believe if you’re meeting up to exchange cards, you shouldn’t have to pay just to track the trade.
- In-person trades allow users to meet locally and exchange cards face-to-face.
- Both parties must confirm the trade within the app after the exchange takes place.
- Shipping deadlines do not apply to in-person trades.
- Trade protection does not apply to in-person trades, as there is no shipping or tracking involved. Users trade at their own risk.
- Cards involved in an active in-person trade are still locked and cannot be listed for sale or included in other trades until the trade is completed or cancelled.
- Cardly Market is not responsible for any disputes, losses, or issues arising from in-person meetups. Users are encouraged to meet in safe, public locations.
4. Fees and Payments
4.1 Transaction Fees
- Selling Fee: 10% seller fee on the sale price (8% for Cardly Market Pro subscribers). Buyers pay an additional 1% buyer fee (0% for Pro subscribers).
- Trade Fee (Shipping Trades): Each user pays a seller fee based on the total market value of the cards they are sending. Standard rate is 10% (8% for Cardly Market Pro subscribers).
- Trade Fee (In-Person Trades): Free — $0. No trade fees are charged for in-person trades.
- Payment Processing: Standard payment processor fees (Stripe) apply to all paid transactions.
- Fees are subject to change with notice. Updated fee schedules will be posted in the app and on our website.
4.2 Payouts
Seller payouts are initiated 3 days after the buyer confirms receipt or 7 days after delivery confirmation, whichever comes first. Payouts are processed through Stripe to your linked bank account. You must complete Stripe onboarding and identity verification to receive payouts. Cardly Market is not responsible for delays caused by your bank or payment processor.
4.3 Cardly Market Pro Subscription
Cardly Market Pro is a paid subscription offering reduced fees, increased trade protection limits, and additional features. Subscriptions auto-renew on a monthly or yearly basis unless cancelled. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
4.4 Cash Offers in Trades
Trades may include a cash component to balance value differences. Cash offered in trades is held in escrow by Cardly Market (processed via Stripe) until the trade is completed and both parties confirm receipt. If a trade is cancelled, escrowed cash is refunded to the original payer.
5. Trade Protection
Cardly Market offers trade protection for eligible transactions:
- Coverage: Up to $500 per transaction for standard users; up to $2,500 per transaction for Cardly Market Pro subscribers.
- Eligible Issues: Item not received, item significantly not as described, counterfeit item, item damaged in transit.
- Requirements: Must use Cardly Market shipping labels and follow all shipping guidelines. Both parties must meet shipping and confirmation deadlines.
- Claims: Must be filed within 7 days of the expected delivery date.
Trade protection does not cover:
- Buyer’s remorse or change of mind
- Minor condition discrepancies (e.g., “Near Mint” vs. “Excellent”)
- Transactions completed outside the Cardly Market platform
- Items shipped without Cardly Market shipping labels or without valid tracking
- Failure to meet shipping or confirmation deadlines
- In-person trades (no shipping or tracking involved)
6. Shipping
- Cardly Market provides integrated shipping labels through our shipping partner (EasyPost). Using Cardly Market shipping labels is required for trade protection eligibility.
- Sellers and traders are responsible for packaging cards safely and securely to prevent damage during transit.
- You must ship within 3 business days of the applicable trigger (payment confirmation for sales, fee payment for trades). Failure to ship on time may result in automatic cancellation, fee refunds to the other party, and potential account penalties.
- Tracking information is automatically shared with both parties when using Cardly Market labels.
- Cardly Market is not liable for items lost or damaged by shipping carriers, but trade protection may apply for eligible transactions.
7. Card Scanning & AI Features
- Cardly Market offers a card scanning feature that uses your device’s camera and artificial intelligence (powered by Google) to identify and catalog collectible cards.
- By using the scanning feature, you grant Cardly Market permission to access your device’s camera and process captured images.
- Card identification results are provided on a best-effort basis. AI recognition may not always be accurate, and you are responsible for verifying and correcting card details before creating listings.
- Images captured during scanning are processed in real-time. They are not stored on our servers unless you choose to create a listing or add a card to your collection.
8. Market Data & Pricing
- Cardly Market displays market values and pricing data sourced from third-party providers, recent historical sales, and other publicly available sources.
- Market values are estimates and are provided for informational purposes only. They do not constitute financial advice or a guarantee of actual sale price.
- Price changes, trending data, and “top movers” are based on third-party data and may not reflect real-time market conditions.
- Cardly Market is not responsible for inaccurate pricing data, and users should perform their own research before buying, selling, or trading.
8.5 Card Breaks Policy
Cardly Market permits live card breaks in deterministic formats only. All outcomes are determined solely by buyer selection or pre-defined break rules. No randomized allocation or chance-based assignment is used at any point.
General Break Rules
- Full stream visibility: Sealed product and the host’s hands must be visible on-screen at all times. Multi-camera setups are permitted.
- Rules disclosure: Every break listing and show notes must state the exact allocation method (e.g., “PYT: Buyer selects team upfront; hits/inserts to matching team; base/bulk shipped if needed for one-card minimum” or “RTYH: Rip live until [exact rarity] met; all cards shipped”).
- One live show only: Each break is conducted in a single live stream. No pre-sales off-platform.
- Cards only: Every buyer must receive a minimum of one card per purchased spot.
- Prohibited terms: Listings containing “wheel,” “random team,” “mystery,” or “repack” are automatically blocked and will not be published.
Prohibited Break Formats
The following break formats are strictly prohibited on Cardly Market:
- Wheelspins / Random Team Breaks: Any format that uses a random number generator, wheel, or chance-based mechanism to assign teams or cards to buyers is not permitted.
- Individual Player Breaks: Breaks where buyers purchase a specific individual player (rather than a team) and receive only cards featuring that player are not allowed.
- Mystery / Repack Breaks: Pre-assembled or repackaged card lots sold as “mystery” or “repack” products are prohibited.
- Any Chance-Based Allocation: Any format where the buyer’s outcome is determined by randomization rather than the buyer’s own selection or pre-defined break rules.
Cardly Market supports only two break formats: Pick Your Team (PYT) and Rip Till You Hit (RTYH) / Rip-and-Ship. Both are deterministic — outcomes are decided by buyer choice or transparent break rules, never by chance.
Pick Your Team (PYT) Breaks
- One sealed box or case is opened per break.
- The seller lists available teams; buyers select and pay for a specific team via auction or Buy-It-Now pricing.
- Hits, inserts, and parallels are shipped to the buyer who selected the matching team.
- Base cards and bulk are shipped as needed to satisfy the one-card-per-buyer minimum.
- Individual teams may be auctioned separately within the same live stream.
Rip Till You Hit (RTYH) / Rip-and-Ship
- The buyer purchases a spot for RTYH to a certain disclosed rarity (e.g., any numbered parallel or better, first autograph).
- The seller rips packs live until that exact rarity (or better) is pulled.
- Every card pulled during the rip is shipped to the buyer. Base card handling is disclosed in the listing.
- A live pack counter and “Hit Achieved” banner are displayed in the stream interface.
- RTYH spots are treated as personal rip-and-ship spots with a fixed “until hit” endpoint.
Seller Obligations
- Sellers must categorize their stream under “Breaks” and provide product images.
- Sellers must comply with all visibility and disclosure rules above.
- Failure to comply may result in stream termination, listing removal, and/or account suspension.
Buyer Protections
- Buyers must confirm their team selection (PYT) or RTYH spot before payment is processed.
- Every buyer is guaranteed a minimum of one card per spot.
- A per-stream spend display is shown to each buyer during live streams.
- Standard support tickets and dispute resolution apply to all break transactions.
9. Points & Rewards Program
- Cardly Market offers a points-based rewards program. Points are earned through eligible activities such as completing trades, making sales, and other in-app actions.
- Points can be redeemed for rewards including but not limited to: free shipping labels, priority shipping upgrades, featured listing boosts, spotlight seller status, and other perks.
- Points have no cash value and cannot be transferred, sold, or exchanged for currency.
- Cardly Market reserves the right to modify, suspend, or discontinue the rewards program at any time, including adjusting point values and available rewards.
- Points earned through fraudulent activity, manipulation, or violation of these Terms will be forfeited, and accounts may be suspended or terminated.
10. Push Notifications & Communications
- By using Cardly Market, you consent to receive electronic communications from us, including push notifications, in-app messages, and emails.
- Transactional notifications (trade updates, shipping alerts, payment confirmations, messages from other users) are essential to the Service and cannot be fully disabled while using the platform.
- You can manage your notification preferences (including promotional notifications) in your account settings at any time.
- You agree that all communications provided electronically satisfy any legal requirement that such communications be in writing.
11. Prohibited Conduct
You agree not to:
- List counterfeit, stolen, or illegally obtained items
- Misrepresent the condition, authenticity, or grading of cards
- Manipulate prices, feedback, ratings, or search results
- Circumvent Cardly Market fees by completing transactions off-platform
- Harass, threaten, discriminate against, or abuse other users
- Create multiple accounts to evade bans or manipulate the system
- Use bots, scrapers, or automated tools to access or collect data from the Service without permission
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Intentionally fail to ship items after receiving payment or accepting a trade
- File false or fraudulent trade protection claims
- Use the in-app messaging system for spam, phishing, or solicitation
- Upload harmful content, malware, or engage in any activity that disrupts the Service
- Violate any applicable local, state, national, or international laws or regulations
12. Intellectual Property
Cardly Market and its content, features, functionality, branding, and source code are owned by Cardly Market and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.
Card images, names, logos, and related trademarks are the property of their respective owners, including but not limited to The Pokémon Company, Wizards of the Coast (Magic: The Gathering), Konami (Yu-Gi-Oh!), Bandai (One Piece Card Game), Ravensburger (Disney Lorcana), Topps, Panini, and Upper Deck. Cardly Market is not affiliated with, endorsed by, or sponsored by any of these companies. Use of these trademarks on Cardly Market is for informational and identification purposes only.
13. User Content
By posting content on Cardly Market (including photos, card descriptions, reviews, and messages), you grant Cardly Market a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service. You represent and warrant that you have the right to post such content and that it does not violate any third-party rights.
Cardly Market does not claim ownership of your content. You may remove your content at any time, but content already distributed or cached may persist.
14. Disputes Between Users
If you have a dispute with another user:
- First, attempt to resolve it directly through in-app messaging.
- If unresolved, open a dispute through the Cardly Market Resolution Center within 7 days of the issue arising.
- Our team will review evidence from both parties (including photos, tracking info, and chat history) and make a determination.
- Resolution Center decisions are final and binding on both parties.
Cardly Market reserves the right to hold funds, cancel transactions, or take other appropriate action during the dispute resolution process.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE ACCURACY OF LISTINGS, MARKET DATA, PRICING INFORMATION, THE QUALITY OR AUTHENTICITY OF CARDS, OR THE CONDUCT OF USERS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDLY MARKET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, ANY TRANSACTION OR TRADE CONDUCTED THROUGH THE SERVICE, OR ANY CONDUCT OF OTHER USERS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO CARDLY MARKET IN THE PAST 12 MONTHS OR (B) $100.
17. Indemnification
You agree to indemnify, defend, and hold harmless Cardly Market and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; (d) any content you post or submit through the Service; or (e) any transaction or trade you conduct through the Service.
18. Termination
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination:
- Your right to use the Service ceases immediately.
- Pending sales will be cancelled, and buyers will be refunded.
- Pending trades will be cancelled, and trade fees and escrowed cash will be refunded.
- Outstanding payouts for completed transactions will still be processed.
- Accrued points and rewards will be forfeited.
You may also delete your account at any time through your account settings. Account deletion is subject to the completion or cancellation of any pending transactions.
19. Mobile Application Terms
- The Cardly Market app is available for download on iOS (Apple App Store) and Android (Google Play Store). Your use of the app is also subject to the applicable app store’s terms and conditions.
- We may release updates to the app from time to time. Some updates may be required for continued use of the Service. You are responsible for keeping the app updated.
- The app requires certain device permissions (camera, notifications, internet access) to function properly. You can manage permissions in your device settings, but disabling certain permissions may limit functionality.
- Apple and Google are not responsible for the Cardly Market app or its content. Any claims related to the app should be directed to Cardly Market, not to the app store provider.
20. Third-Party Services
Cardly Market relies on third-party services to operate, including but not limited to:
- Stripe for payment processing and payouts
- Firebase (Google) for authentication, data storage, and notifications
- EasyPost for shipping label generation and tracking
- Google AI for card scanning and recognition
- Third-party APIs for card pricing and market data
Your use of these third-party services may be subject to their own terms and privacy policies. Cardly Market is not responsible for the availability, accuracy, or conduct of third-party services.
21. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the app, by email, or by posting the updated Terms on our website. The “Last updated” date at the top of this page will be revised accordingly. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the Service.
22. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in California.
23. Arbitration Agreement
Any disputes, claims, or controversies arising from or relating to these Terms or your use of the Service shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in California or, at your election, may be conducted remotely. You and Cardly Market each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding.
Notwithstanding the above, either party may seek injunctive or equitable relief in court for intellectual property disputes or to prevent irreparable harm.
24. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
25. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cardly Market regarding your use of the Service and supersede all prior agreements, representations, and understandings.
26. Force Majeure
Cardly Market shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to natural disasters, pandemics, government actions, internet or infrastructure failures, acts of terrorism, or labor disputes.
